Tonight, I had my "final" in Trial Advocacy, where we had to do a full mock trial. I was on the defense, representing a train company. The plaintiff was the estate of a guy who ran his car into the train. The jury apportioned only 15% of the negligence to us, and 85% to him. Apparently my dramatic closing had a big impact with the jury.

Why didn't the guy jump the train? That's what Bo & Luke Duke would have done!

I'll be entertained if E can pull a win on this. It'll really stick it to your plaintiffs with their fancy schmancy power points.
This is very interesting. I saw your comment on Matt ( Caustic's ) LJ page ( he is my friend and I play his music on my radio show ), so I glanced at your profile page. I see that you know some of the same friends that i have on my LJ. ( Black Oil, Kristy, etc..) and that you are ALSO a member of urban decay. What a small world. :)
Then I read your post about the mock train crossing auto accident and the respective payouts for the settlement. It turns out I work in the railroad industry, having worked on a freight railroad in NJ as an engineer and conductor and have dealt with a grade crossing accident ( car hit our locomotive at a road crossing when i was bringing the train across ). I also own my own locomotives and other railroad machinery that i rent out. I also belong to an online forum that discusses car / train railroad crossing accidents. I am a strong believer that the fault of said accidents are VERY so the faults of the mototists and NOT the RR. I would have loved to hear the minutes of your "closing statements" conducted at your trial. BTW, I am also a big train geek, LOL.
Very interesting how i came across all these "parallels" that exist between us. I have appreciation with things like this and just wanted to share that with you. | |
